These Terms & Conditions for Manufacture Fran\u00e7aise du Cycle, whose head offices are located at 27 rue Marcel Bruneli\u00e8re, 44270 Machecoul-Saint-M\u00eame, France, will be applicable as from 1\u00a0March 2019.<\/p>


Article 1. Purpose and scope<\/strong><\/p>

1.1. These Terms & Conditions apply to all orders placed on the website Sunn.fr (hereinafter referred to as the \u201cWebsite\u201d). The applicable Terms & Conditions are those in effect at the time when the order was placed.<\/p>


1.2. All product orders entail the full and unreserved acceptance and approval hereof by the customer placing the order (hereinafter the \u201cCustomer\u201d). These Terms & Conditions take precedence over any other Customer documents, including their own terms and conditions, unless our company has given its express, prior agreement otherwise.<\/p>


1.3. All documents other than these Terms & Conditions, in particular the terms and conditions posted at our company\u2019s shops, our catalogues, our brochures, our advertisements and our manuals, are purely provided on an information, indicative basis and shall not under any circumstances be endowed with any contractual value.<\/p>


1.4. For the purposes of the Terms & Conditions, a Customer is any natural person (excluding professional buyers) who is at least 18 years of age and who has the legal capacity to place an order on the Website and comply with these Terms & Conditions or who has parental permission allowing them to do so, as well as any legal entity that does not retail the products sold on the Website.<\/p>

\u00a0<\/p>

Article 2. Products<\/strong><\/p>

The Website describes the main features and characteristics of the products and services that are available for purchase on it. If, in spite of the precautions we take, any errors should appear in those descriptions, Sunn shall not be held liable for such errors. In addition, the Customer is encouraged to review the user manuals and any other information enclosed with a product or appearing on the product or its packaging, particularly information relating to:<\/p>


1) Any user precautions;<\/strong><\/p>


2) The conditions of and restrictions on use of the product;<\/strong><\/p>


3) Product upkeep.<\/strong><\/p>


Although every effort is made to ensure that the colours in the product photos that appear on the Website are true to the originals, variations may occur, namely as a result of technical limitations on computer hardware renders different colours. As a result, the photographs are provided as product illustrations, in support of the text, and are not contractually binding. Under no circumstances may Sunn be held liable on the basis of those photographs. The Customer, in accepting the Terms & Conditions upon submission of their order, accepts full responsibility for the requested personalisation and any consequences thereof.<\/p>

Article 3. Pricing<\/strong><\/p>

All prices are displayed in euros, inclusive of value added tax (VAT). VAT is calculated and applied at the rate in effect at the time of order placement.<\/p>

These prices are understood as being exclusive of any shipping costs which are borne by the Customer.<\/p>

The Customer will be notified of those costs before final confirmation of the order.<\/p>

\u00a0<\/p>


Article 4. Order placement <\/strong><\/p>

The Customer places their order according to the process in effect on Sunn.fr. That process breaks down as follows:<\/p>


– The Customer selects the product(s) they want to order.<\/p>


– The Customer selects a delivery method. At this time, the associated shipping costs are displayed.<\/p>


– The Customer selects a payment method, such as debit\/credit card (for online payment).<\/p>


– The Customer receives an order confirmation email.<\/p>


When placing their first order, the Customer will be required to provide all the necessary information about themself so that Sunn can effectively manage all current and future orders and shipments, including the Customer\u2019s full name, postal address(es), email address and telephone number(s). All of the Customer\u2019s information is then protected by a password chosen by the Customer, which they may modify at any time. The Customer can also edit their personal information at any time. The products are offered to Customers subject to availability. Consequently, Sunn in no way commits to honouring every order received via the Website. However, Sunn undertakes to inform the Customer if any part or all of the ordered product(s) are unavailable, under the conditions set forth in Article\u00a05 hereof. Sunn reserves the right to refuse to ship an order to a Customer in the event of past disputes with the latter. Likewise, Sunn reserves the right to refuse to ship an order to a Customer whose address information is incomplete, unclear or in any other way does not allow for delivery to be planned under the right conditions. Sunn reserves the right to ask the Customer for proof of residence (such as a utility bill) where justified by the total price or the contents of the order. Sunn declines all responsibility for the consequences of any incidents outside its control \u2013 particularly in the case of a force majeure event \u2013 that may obstruct, delay or impede online order placement.<\/p>


Sunn has an order analysis (fraud detection) system, so information relating to the Customer\u2019s order undergoes automatic data processing whose controller is PayPal. The purpose of this automated data processing is to define a level of analysis for the transaction and prevent debit\/credit card fraud. Sunn is the recipient of your order-related data. Failure to communicate the required information for your order will impede your transaction\u2019s analysis and therefore fulfilment. If payment is declined on the grounds of fraudulent use of a debit\/credit card, the account information will be registered in a payment incident file created by PayPal.<\/p>


Any improper or incorrect information may likewise undergo specific processing.<\/p>

\u00a0<\/p>


Article 5. Product availability<\/strong><\/p>

In the event that part of an order becomes definitively unavailable after it was placed, Sunn will notify the Customer by email as soon as possible. In response to that email, the Customer will have forty-eight (48) hours in which to cancel their order, if they so choose.<\/p>


Once those 48\u00a0hours have passed, in the absence of an explicit response from the Customer, the available portion of the order will be shipped.<\/p>


In the event that an entire order becomes definitively unavailable after it was placed, Sunn will cancel the order and notify the Customer by email. The Customer\u2019s account will only be charged for products and services that were ordered and actually shipped, as well as the associated shipping costs. If the Customer\u2019s account was already charged for the full amount of the original order, a refund will be issued as soon as possible, equal to the total price of the products and services that were not shipped plus the associated shipping costs.<\/p>

Article 6. Shipping<\/strong><\/p>

For order shipments, the Customer can choose, when placing an order, the available option is shipment to the address (within metropolitan France) provided during order placement by a carrier chosen by Sunn.<\/p>


Sunn will make every effort to deliver the Customer\u2019s order in metropolitan France within seven (7) business days of order confirmation (a lead time that is usually met). The delivery lead time indicated to the Customer on the Website at the time of order placement is an indication only and does not constitute a firm commitment on the part of Sunn. If a Customer orders products for shipment to a shared address (a hospital, works council, holiday camp, etc.), the products will be delivered by Sunn\u2019s carrier to the exact address provided by the Customer when placing the order, so long as the order can be received by a third party.<\/p>


Sunn is not responsible for having the products taken all the way to the Customer.<\/p>


The following shipping addresses are not allowed: hotels and military bases. Sunn shall not be implicated or held liable for any incidents outside its control \u2013 particularly in the case of a force majeure event or an incident caused by the carrier \u2013 that may obstruct, delay or impede the shipment or delivery of the ordered products to the Customer. No compensation or damages shall be paid to the Customer in the event of the carrier\u2019s failure to deliver an order or in the event of non-compliance with the delivery lead times indicated on the Website.<\/p>

Further, Sunn reminds the Customer of their obligation to carefully verify and inspect the condition of the products upon delivery. In the case of any anomalies (damaged packaging, missing, damaged or broken products, etc.), the Customer:<\/p>


\u2013 Must make a note of the relevant reservations on the delivery slip;<\/p>


\u2013 Must send a statement of reservations to the carrier by registered letter with acknowledgement of receipt within three (3) business days;<\/p>


\u2013 Will have three (3) business days to notify Sunn of the reservations by registered letter with acknowledgement of receipt.<\/p>


If these reservations are not duly recorded on the delivery slip, the Customer will not be able to lodge a claim with Sunn in the name of the products\u2019 shipping and delivery.<\/p>


For orders in excess of \u20ac500, the delivery lead time will be no more than two (2) months.<\/p>

For any returns made due to a non-compliant shipment, a declined order or an order not collected (from the carrier, etc.) in the event that the Customer was absent at the time of attempted delivery, Sunn will charge the Customer for:<\/p>


– The shipping costs to the Customer\u2019s address;<\/p>


– A restocking fee of \u20ac15.<\/p>


The replacement products will be shipped upon payment of those charges by the Customer.<\/p>

\u00a0<\/p>


Article 7. Shipping charges<\/strong><\/p>

Unless otherwise agreed, the Customer will bear the cost of their products\u2019 shipment.<\/p>

Those charges are indicated on the Website www. sunn.fr<\/strong> at the time of order placement.<\/p>

Those amounts are also stated in the order confirmations emailed to the Customer.<\/p>

These shipping charges, expressed in euros inclusive of VAT, are dependent on the total weight of the order and\/or are flat charges for bikes, as follows:<\/p>

  • Bike shipping<\/u><\/strong><\/em>:<\/strong><\/em><\/li><\/ul>

    Metropolitan France, excluding Corsica:<\/strong> A flat charge of \u20ac20 for the first bike and \u20ac10 per additional bike.<\/p>


    Metropolitan France, Corsica:<\/strong> A flat charge of \u20ac40 for the first bike and \u20ac20 per additional bike.<\/p>

    \u00a0<\/p>

    • Other shipping<\/u><\/strong><\/em>:<\/strong><\/em><\/li><\/ul>

      Metropolitan France (including Corsica): A flat charge of \u20ac6; no charge if the order includes a bike.<\/p>


      Shipping charges are subject to change without special notice. In any case, bikes will be delivered to the Customer by a special carrier chosen by Manufacture Fran\u00e7aise du Cycle.<\/p>


      Under no circumstances may the Customer impose their own choice of carrier.<\/p>

      \u00a0<\/strong><\/p>

      Article 8. Order payment<\/strong><\/p>

      The products ordered by the Customer are payable upon order placement, by cheque against a bank in France made out to Manufacture Fran\u00e7aise du Cycle, by debit\/credit card (Visa, Eurocard or Mastercard) or via PayPal (with or without a PayPal account). For certain shipments outside metropolitan France, payments may be accepted from foreign banks. In any case, payments are to be issued exclusively in EUROS.<\/p>


      The Customer\u2019s payment will be deposited within a few days of order placement.<\/p>


      Under the conditions laid down in Article\u00a05 of these Terms & Conditions, and in the event that Sunn is unable to ship all or part of the order, the Customer\u2019s account will be credited for the price of the unshipped product(s) as well as the associated shipping charges, as swiftly as possible.<\/p>


      Sunn uses PayPal\u2019s secure payment systems (SSL protocol).<\/p>


      For transactions made by debit\/credit card, the Customer will automatically be connected to the PayPal server.<\/p>


      The Customer\u2019s bank or card information will be encrypted and will not be sent to, or therefore stored by, Sunn\u2019s information systems.<\/p>


      Any late payments will automatically accrue late fees in the amount of three (3) times the legal interest rate then in effect, beginning on the first day late.<\/p>


      For orders paid by CHEQUE, Manufacture Fran\u00e7aise du Cycle will set aside the ordered product(s) while awaiting receipt and clearance of a cheque in the amount of the order.<\/p>


      No products will be shipped before the amount owed has been received and cleared. In any case, any amounts paid prior to final confirmation of the order by the Customer will be considered as advance payments.<\/p>

      \u00a0<\/p>


      Article 9. Retention of ownership \u2013 Transfer of risk<\/strong><\/p>

      Products that have been ordered and delivered will remain the property of Sunn<\/strong> until such time as the Customer\u2019s payment in full has been received and cleared.<\/p>


      However, the Customer assumes all risks (namely including loss, theft of damage) relating to the delivered products, from the actual date of their delivery.<\/p>

      \u00a0<\/p>


      Article 10. Right of withdrawal<\/strong><\/p>

      Pursuant to Article\u00a0L121-16 of the French Consumer Code, the Customer has seven (7) days from the date of delivery of the ordered products in which to change their mind.<\/p>

      To exercise this right of withdrawal and return some or all of the ordered products, the Customer will first need to contact Customer Service at contact@sunn.fr<\/strong>.<\/p>

      Within a few days of that contact, the Customer will receive an email with a return slip which they must necessarily enclose with the returned product(s). In the absence of that slip, the product return will be deemed non-compliant and will be processed in accordance with the conditions laid down in Article\u00a012 hereof.<\/p>

      If the Customer chooses to use their right of withdrawal, each product must be returned in its original packaging, accompany by any and all accessories and manuals. Further, returned products must be in perfect condition and never have been used or worn.<\/p>

      Any products that are returned incomplete, damaged, used or dirty will be deemed non-compliant and will be processed in accordance with the conditions laid down in Article\u00a012 hereof.<\/p>

      The Customer is free to choose any mode of transport through which to return the product(s) to Sunn<\/strong>. The associated return shipping charges will be the Customer\u2019s responsibility. As a function of the selected mode of transport, the Customer will be responsible for packaging and wrapping the products so they can travel with no risk of damage.<\/p>

      The Customer\u2019s refund will be issued in the form of a credit to the bank account associated with the debit\/credit card they used to pay for the original order, or by cheque if that was the original payment method, once the product returned in the name of the Customer\u2019s right of withdrawal has been received by Sunn, with no return non-compliance issues detected.<\/p>

      The refund will be issued within thirty (30) days of receipt of the return at our depots.<\/p>

      Only the price of the ordered and returned product will be refunded to the Customer, excluding all related charges, especially shipping costs, that were borne by the Customer at the time of placement of the original order.<\/p>

      Article 11. Product exchanges<\/strong><\/p>

      Aside from the right of withdrawal explained in Article\u00a010 hereof, the Customer may request an exchange of a product in the following three (3) scenarios:<\/p>

      • If the delivered product does not match the ordered product;<\/li>
      • If the size of the delivered product matches the size of the ordered product but does not work for the Customer;<\/li>
      • If the ordered product was delivered to the Customer with a defect caused by the carrier.<\/li><\/ul>

        \u00a0<\/p>

        Regardless of the scenario, the Customer will have forty-eight (48) hours from receipt of the ordered product to request its exchange from Sunn<\/strong>, either by email or telephone. Within a few days of that contact, the Customer will receive an email containing instructions for returning the product they want to exchange, along with a return slip which they must necessarily enclose with the product returned for an exchange.<\/p>

        In the absence of that slip, the product return will be deemed non-compliant and will be processed in accordance with the conditions laid down in Article\u00a012 hereof.<\/p>

        Upon receipt of those instructions, the Customer will have seven (7) days in which to ship the product back.<\/p>

        Whatever the Customer\u2019s scenario, they must contact Sunn<\/strong> Customer Service by sending an email to contact@sunn.fr, presenting all the relevant information about the order and their complaint (order number, bike product number, order date, etc.).<\/p>

        The Customer will then be given special instructions. Those instructions will replace points 11a, 11b and 11c below.<\/p>

        Each product must be returned in its original packaging, accompany by any and all accessories and manuals. Further, returned products must be in perfect condition and never have been used or worn.<\/p>


        Aside from the scenario in which the product was delivered to the Customer with a defect caused by the carrier, any products that are returned incomplete, damaged, used or dirty will be deemed non-compliant and will be processed in accordance with the conditions laid down in Article\u00a012 hereof.<\/p>

        Upon receipt of a compliant product returned for exchange, Sunn<\/strong> will perform the exchange and ship the new product to the Customer within seven (7) business days. It is however recalled that Sunn<\/strong> shall not be held liable for non-receipt of the Customer\u2019s return shipment.<\/p>

        If the product returned by the Customer is no longer available for exchange on the effective return date, Sunn<\/strong> will issue a refund to the Customer, as outlined below.<\/p>

        1. A) If the delivered product does not match the ordered product<\/strong><\/li><\/ol>

          In this scenario, Sunn<\/strong> will cover the return shipping costs as well as the cost of shipping the exchange order to the Customer.<\/p>

          1. B) If the delivered product matches the ordered product but does not work for the Customer<\/strong><\/li><\/ol>

            In this scenario, all shipping costs associated with returning the product for exchange will be borne by the Customer, and Sunn<\/strong> will cover the cost of shipping the exchange order to the Customer.<\/p>

            The Customer is free to choose any mode of transport through which to return the product to Sunn<\/strong> for exchange. As a function of the selected mode of transport, the Customer will be responsible for packaging and wrapping the products so they can travel with no risk of damage.<\/p>

            1. C) If the ordered product was delivered to the Customer with a defect caused by the carrier<\/strong><\/li><\/ol>

              Sunn reminds the Customer of their obligation to carefully verify and inspect the condition of the products upon delivery. In the case of any anomalies (damaged packaging, missing, damaged or broken products, etc.), the Customer:<\/p>

              • Must make a note of the relevant reservations on the delivery slip;<\/li>
              • Will have three (3) business days to notify Sunn<\/strong> of those reservations.<\/li><\/ul>

                If these reservations are not duly recorded on the delivery slip within three (3) business days, the Customer will not be able to lodge a claim with Sunn<\/strong> in the name of the product\u2019s shipping and delivery.<\/p>

                The Customer will receive an email containing instructions for returning the product that was delivered with a defect.<\/p>

                The Customer must return the product that was delivered defective, in the same condition as it was received, in accordance with the instructions sent to the Customer.<\/p>

                \u00a0<\/p>


                Article 12. Non-compliant product returns<\/strong><\/p>

                Articles 10 and 11 above outlined the conditions for the compliance or non-compliance of returned and exchanged products.<\/p>

                Any non-compliant product returns will be sent back to the Customer, with all the associated shipping costs charged to the latter.<\/p>

                The Customer will be notified by email of their non-compliant product return. That email will contain the necessary information for the Customer to make payment of the aforementioned associated shipping costs by debit\/credit card.<\/p>

                The product(s) will be shipped back to the Customer immediately upon payment in full of those shipping charges.<\/p>

                \u00a0<\/p>


                Article 13. Statutory warranties<\/strong><\/p>

                Aside from our commercial warranties, and in accordance with regulation, Sunn<\/strong> undertakes to adhere to the obligations set for in the warranties attached to the products sold on the Website, as set forth in the below articles of the French Consumer Code and the French Civil Code.<\/p>

                According to Article L217-3 of the Consumer Code, the seller is bound to deliver a product that is compliant with the contract and musts answer for any compliance defects at the time of delivery. The seller is likewise responsible for any compliance defects stemming from the product\u2019s packaging or assembly or installation instructions where assembly or installation is the seller\u2019s responsibility under the contract or was carried out under the seller\u2019s responsibility.<\/p>

                Article\u00a01641 of the Civil Code: The seller is bound by the warranty against hidden defects in the item sold that make the item unsuitable for its intended use or that diminish its use so much that the buyer would not have acquired, or would only have paid a lesser price for it, had the buyer been aware of those defects.<\/p>

                Article\u00a01648 of the Civil Code: An action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the vice.<\/p>

                Our bicycles are protected by warranty against manufacturing defects:<\/p>

                • For life for rigid frames (aluminium or steel);<\/li>
                • Two (2) years for full suspension frames;<\/li>
                • Two (2) years for carbon frames;<\/li>
                • Two (2) years for suspension forks.<\/li>
                • Two (2) years for parts (excluding wearing parts).<\/li><\/ul>

                  The conditions for warranty coverage are defined by Sunn<\/strong> Customer Service.<\/p>

                  All requests to return a product under a statutory and\/or commercial warranty must adhere to the following procedure and rules:<\/p>


                  – The Customer must contact Sunn After-sales Service at sav@sunn.fr, which will determine whether or not the issue is covered by warranty and will define how it will be handled.<\/p>


                  – The Customer must return the product in its original packaging or in packaging that offers maximum protection to the product (box, pallet, etc.).<\/p>


                  – The Customer is responsible for obtaining a compliant packing container. Sunn is not bound to provide that packaging or reimburse the Customer for its purchase.<\/p>


                  – Any returned product that does not comply with its optimal packaging and storage conditions will be deemed non-compliant and treated as such, in accordance with Article\u00a012 above.<\/p>


                  – In that case, the product will not be covered by warranty.<\/p>


                  – All product returns must only be made after first contacting and receiving the approval of Sunn Customer Service.<\/p>

                  Article 14. Customer Service<\/strong><\/p>

                  Sunn Customer Service is available to provide information and answer questions. They can be reached:<\/p>

                  • By email sent to contact@sunn.fr;<\/li>
                  • By post sent to Manufacture Fran\u00e7aise du Cycle, Sunn Service Consommateurs, BP6\u00a0 ZI la Seiglerie, 44270\u00a0 MACHECOUL.<\/li><\/ul>

                    Article 15. Intellectual property<\/strong><\/p>

                    All the elements on the Website are protected by copyright and intellectual property rights covering entire world, and including its:<\/p>

                    • Texts;<\/li>
                    • Images;<\/li>
                    • Audio and\/or visual files;<\/li>
                    • The technology and developments underlying those elements.<\/li><\/ul>

                      Any Customer with a personal website, and more generally any third party that wishes to do so, may place a simple hyperlink on their website directing visitors to the Website\u2019s home page, on condition of obtaining the express authorisation of Sunn<\/strong>.<\/p>

                      If granted, that authorisation shall not, under any circumstances, be construed as an implicit affiliation agreement.<\/p>

                      \u00a0<\/p>


                      Article 16. Liability<\/strong><\/p>

                      Sunn only has a best endeavours obligation towards the Customer, particularly when the latter visits the various pages of the Website, during the order placement process, during shipping and delivery, and in providing post-delivery services. Sunn\u2019s liability shall not be incurred for any inconveniences or damage inherent to use of the internet, namely including the disruption of service, intrusion by unauthorised third parties, the presence of computer viruses or any occurrence that qualifies as a force majeure event as defined by French courts of law.<\/p>


                      Nor may Sunn\u2019s liability be incurred on the grounds of any economic loss or bodily injury ensuing from the improper use of the products sold on the Website.<\/p>

                      \u00a0<\/p>


                      Article 17. Named information<\/strong><\/p>

                      The information collected during order placement is automatically processed for the purpose of managing and tracking that order.<\/p>


                      The sole aim of this data collection is to make successful deliveries, improve quality of service and more generally better meet the Customer\u2019s expectations. Under no circumstances will those data be transferred outside our company.<\/p>


                      Pursuant to the French Data Protection Act of 6\u00a0January 1978, as amended, the Customer has the right to access, edit, rectify and erase their data. They may exercise this right by sending an email via the Website\u2019s \u201cContact\u201d page or a letter to Customer Service at MANUFACTURE FRANCAISE DU CYCLE, 27 rue Marcel Bruneli\u00e8re 44270 MACHECOUL-SAINTMEME, (A l\u2019attention du service Sunn.fr<\/strong>)<\/p>

                      Article 18. Applicable law and jurisdiction<\/strong><\/p>

                      These Terms & Conditions are governed by French law.                       1. PR\u00c9AMBULE<\/strong>
                      L\u2019application SUNN (ci-apr\u00e8s l\u2019\u00ab Application \u00bb) est fournie par la soci\u00e9t\u00e9 MANUFACTURE FRANCAISE DU CYCLE, Soci\u00e9t\u00e9 par Actions Simplifi\u00e9e (\u00e0 associ\u00e9 unique), 27, rue Marcel Bruneli\u00e8re, BP 6, 44270 MACHECOUL (ci-apr\u00e8s \u00ab MANUFACTURE FRANCAISE DU CYCLE \u00bb).
                      L\u2019Application fournit \u00e0 tout utilisateur, propri\u00e9taire d\u2019un v\u00e9lo de la marque SUNN \u00e9quip\u00e9 d\u2019un syst\u00e8me de g\u00e9olocalisation et alarme, (ci-apr\u00e8s l\u2019\u00ab Utilisateur \u00bb) qui y cr\u00e9e un compte (ci-apr\u00e8s un \u00ab Compte \u00bb), diverses fonctionnalit\u00e9s pr\u00e9sent\u00e9es ci-apr\u00e8s, relatives \u00e0 son v\u00e9lo SUNN et \u00e0 son utilisation, en contrepartie du paiement d\u2019un abonnement annuel.
                      Les pr\u00e9sentes conditions g\u00e9n\u00e9rales d\u2019utilisation (ci-apr\u00e8s les \u00ab CGU \u00bb) d\u00e9terminent les conditions d\u2019utilisation de l\u2019Application par l\u2019Utilisateur et r\u00e9gissent la relation contractuelle entre celui-ci et MANUFACTURE FRANCAISE DU CYCLE.
                      L\u2019Utilisateur peut trouver les informations requises par l\u2019article L.221-5 du Code de la consommation, sur le descriptif de l\u2019Application depuis l\u2019App Store (IOS 14 et ult\u00e9rieurs) ou Google Play Store (Android 5 et ult\u00e9rieurs) accessibles via votre t\u00e9l\u00e9phone mobile et dans les pr\u00e9sentes CGU.

                      2. FORMATION DU CONTRAT<\/strong>
                      Les pr\u00e9sentes CGU sont syst\u00e9matiquement pr\u00e9sent\u00e9es \u00e0 l\u2019Utilisateur et soumises \u00e0 sa validation lors de la cr\u00e9ation de son Compte via une case \u00e0 cocher.
                      La cr\u00e9ation d\u2019un Compte vaut acceptation pleine et enti\u00e8re des pr\u00e9sentes CGU par l\u2019Utilisateur et forme le contrat avec MANUFACTURE FRANCAISE DU CYCLE concernant l\u2019utilisation de l\u2019Application.
                      En cr\u00e9ant son Compte, l\u2019Utilisateur d\u00e9clare \u00eatre majeur et avoir la capacit\u00e9 l\u00e9gale pour s\u2019engager.<\/p>


                      3. Cr\u00e9ation du compte<\/strong>
                      Afin de pouvoir utiliser l\u2019Application, l\u2019Utilisateur doit cr\u00e9er un Compte en suivant les modalit\u00e9s d\u2019inscription. L\u2019Utilisateur est tenu de renseigner ses nom, pr\u00e9nom, date de naissance et adresse e-mail et de choisir un mot de passe personnel permettant de lui r\u00e9server l\u2019acc\u00e8s \u00e0 son Compte. L\u2019Utilisateur doit \u00e9galement renseigner le num\u00e9ro de s\u00e9rie de son v\u00e9lo SUNN afin d\u2019appairer ce dernier avec son Compte.
                      MANUFACTURE FRANCAISE DU CYCLE adresse ensuite un e-mail de v\u00e9rification \u00e0 l\u2019Utilisateur \u00e0 l\u2019adresse e-mail renseign\u00e9e, afin que l\u2019Utilisateur valide cette derni\u00e8re en cliquant sur un lien hypertexte. La validation de l\u2019adresse e-mail par ce lien permet de confirmer la cr\u00e9ation du Compte et de donner acc\u00e8s \u00e0 l\u2019Utilisateur \u00e0 l\u2019Application.
                      L\u2019Utilisateur certifie que les informations renseign\u00e9es dans son Compte sont compl\u00e8tes et conformes \u00e0 la r\u00e9alit\u00e9 et s\u2019engage \u00e0 les mettre \u00e0 jour en cas de changement. L\u2019Utilisateur est seul responsable de la confidentialit\u00e9 de ses identifiant et mot de passe et de la robustesse de ce dernier. L\u2019Utilisateur est invit\u00e9 pour cela \u00e0 consulter les recommandations de l\u2019ANSSI accessibles \u00e0 cette adresse : https:\/\/www.ssi.gouv.fr\/guide\/mot-de-passe.
                      Tout acc\u00e8s au Compte de l\u2019Utilisateur \u00e0 l\u2019aide de ses identifiant et mot de passe et toute action effectu\u00e9e sur l\u2019Application \u00e0 partir de son Compte seront r\u00e9put\u00e9s effectu\u00e9s par l\u2019Utilisateur. MANUFACTURE FRANCAISE DU CYCLE n\u2019est en aucun cas responsable des cons\u00e9quences de tout acc\u00e8s non autoris\u00e9 au Compte de l\u2019Utilisateur \u00e0 l\u2019aide de ses identifiant et mot de passe.<\/p>


                      4. Droit de r\u00e9tractation<\/strong>
                      Conform\u00e9ment \u00e0 l\u2019article L. 221-18 du Code de la consommation, l\u2019Utilisateur dispose d\u2019un droit de r\u00e9tractation qu\u2019il peut exercer dans un d\u00e9lai de quatorze (14) jours \u00e0 compter de la validation des CGU lors de la cr\u00e9ation de son Compte.
                      Le d\u00e9lai pour exercer celui-ci commence \u00e0 courir le lendemain du jour de l\u2019installation de l\u2019Application SUNN et prend fin \u00e0 l\u2019expiration de la derni\u00e8re heure du dernier jour du d\u00e9lai de quatorze (14) jours. Si le d\u00e9lai pr\u00e9cit\u00e9 expire un samedi, un dimanche ou un jour f\u00e9ri\u00e9 ou ch\u00f4m\u00e9, il est prorog\u00e9 jusqu\u2019au premier jour ouvrable suivant.
                      Pour exercer son droit de r\u00e9tractation, l\u2019Utilisateur formera une demande depuis l\u2019App Store (IOS 14 et ult\u00e9rieurs) ou Google Play Store (Android 5 et ult\u00e9rieurs).
                      Dans le cas o\u00f9 l\u2019Utilisateur exercerait son droit de r\u00e9tractation dans le d\u00e9lai susvis\u00e9 malgr\u00e9 l\u2019utilisation imm\u00e9diate de l\u2019Application, MANUFACTURE FRANCAISE DU CYCLE ne serait d\u00e9bitrice d\u2019aucune somme \u00e0 son \u00e9gard compte tenu de la gratuit\u00e9 de l\u2019abonnement \u00e0 l\u2019Application pour les deux premi\u00e8res ann\u00e9es, conform\u00e9ment \u00e0 l\u2019article 6 ci-apr\u00e8s. L\u2019exercice du droit de r\u00e9tractation par l\u2019Utilisateur entrainera la cl\u00f4ture de son Compte et l\u2019impossibilit\u00e9 d\u2019utiliser l\u2019Application.<\/p>


                      5. Services offerts par l\u2019Application<\/strong>
                      L\u2019Application permet \u00e0 l\u2019Utilisateur de b\u00e9n\u00e9ficier des fonctionnalit\u00e9s suivantes sur son v\u00e9lo SUNN associ\u00e9 avec son Compte, lorsque son v\u00e9lo est \u00e9quip\u00e9 d\u2019un syst\u00e8me de g\u00e9olocalisation :
                      G\u00e9olocalisation de son v\u00e9lo SUNN ;
                      Notifications sur l\u2019Application l\u2019informant en cas de d\u00e9placement de son v\u00e9lo SUNN ;
                      D\u00e9clenchement d\u2019une alarme \u00e0 distance ;
                      D\u00e9sactivation \u00e0 distance de l\u2019assistance \u00e9lectrique de son v\u00e9lo SUNN ;
                      T\u00e9l\u00e9chargement d\u2019une fiche signal\u00e9tique du mod\u00e8le de son v\u00e9lo SUNN et de sa position g\u00e9ographique ;
                      Consultation de donn\u00e9es et statistiques sur l\u2019utilisation qu\u2019il fait de son v\u00e9lo SUNN.<\/p>


                      6. Conditions financi\u00e8res<\/strong>
                      En cr\u00e9ant un Compte, l\u2019Utilisateur s\u2019engage \u00e0 payer \u00e0 MANUFACTURE FRANCAISE DU CYCLE le montant de l\u2019abonnement annuel en contrepartie des fonctionnalit\u00e9s de l\u2019Application. Le montant de l\u2019abonnement annuel est indiqu\u00e9, sur le descriptif de l\u2019Application et dans le store o\u00f9 elle est propos\u00e9e.
                      L\u2019abonnement annuel est payable par avance \u00e0 la date anniversaire de la cr\u00e9ation du Compte de l\u2019Utilisateur, par pr\u00e9l\u00e8vement sur le compte bancaire associ\u00e9 \u00e0 la carte bancaire dont les donn\u00e9es ont \u00e9t\u00e9 renseign\u00e9es par l\u2019Utilisateur sur le Store. \u00c0 cet effet, l\u2019Utilisateur s\u2019engage \u00e0 maintenir \u00e0 jour les donn\u00e9es de sa carte bancaire pour permettre ce pr\u00e9l\u00e8vement. Dans le cas o\u00f9 le paiement ne pourrait pas \u00eatre effectu\u00e9 \u00e0 l\u2019\u00e9ch\u00e9ance, MANUFACTURE FRANCAISE DU CYCLE pourra suspendre imm\u00e9diatement le Compte de l\u2019Utilisateur jusqu\u2019\u00e0 r\u00e9gularisation du paiement.
                      Les deux (2) premi\u00e8res ann\u00e9es d\u2019abonnement \u00e0 l\u2019Application sont gratuites.
                      A compter de la troisi\u00e8me ann\u00e9e, l\u2019Utilisateur sera pr\u00e9lev\u00e9 du montant de l\u2019abonnement \u00e0 la date anniversaire de cr\u00e9ation sur le compte bancaire renseign\u00e9 lors de son inscription, sauf si l\u2019Utilisateur cl\u00f4ture son compte avant la date anniversaire de la 3\u00e8me ann\u00e9e.<\/p>


                      7. Dur\u00e9e et r\u00e9siliation<\/strong>
                      \u00c0 compter de la cr\u00e9ation de son Compte, l\u2019Utilisateur est engag\u00e9 au titre du contrat avec MANUFACTURE FRANCAISE DU CYCLE pour une dur\u00e9e de deux (2) ann\u00e9es.
                      \u00c0 l\u2019issue de cette p\u00e9riode initiale de deux (2) ann\u00e9es, le contrat entre l\u2019Utilisateur et MANUFACTURE FRANCAISE DU CYCLE est renouvel\u00e9 tacitement \u00e0 chaque date anniversaire de la cr\u00e9ation de son Compte, pour des p\u00e9riodes d\u2019un (1) an.
                      L\u2019Utilisateur peut r\u00e9silier le contrat avec MANUFACTURE FRANCAISE DU CYCLE \u00e0 tout moment en proc\u00e9dant \u00e0 son d\u00e9sabonnement via le Store. La r\u00e9siliation prendra effet \u00e0 l\u2019issue de l\u2019abonnement en cours. MANUFACTURE FRANCAISE DU CYCLE ne proc\u00e8dera \u00e0 aucun remboursement du montant de l\u2019abonnement annuel pay\u00e9 par avance.
                      En cas de r\u00e9siliation par l\u2019Utilisateur au cours de la p\u00e9riode de gratuit\u00e9, MANUFACTURE FRANCAISE DU CYCLE ne proc\u00e8dera \u00e0 aucun pr\u00e9l\u00e8vement.
                      En cas de manquement d\u2019une Partie \u00e0 l\u2019une de ses obligations vis\u00e9es aux articles 3, 5, 6, 8, 9 ou 12 des CGU, l\u2019autre Partie pourra r\u00e9silier le contrat de plein droit et sans formalit\u00e9 judiciaire, apr\u00e8s mise en demeure d\u2019y rem\u00e9dier rest\u00e9e infructueuse \u00e0 l\u2019issue d\u2019un d\u00e9lai de quinze (15) jours, adress\u00e9e par lettre recommand\u00e9e avec avis de r\u00e9ception.<\/p>


                      8. Engagements de l\u2019Utilisateur<\/strong>
                      L\u2019Utilisateur certifie que les informations renseign\u00e9es dans son Compte sont exactes, compl\u00e8tes et \u00e0 jour. L\u2019Utilisateur s\u2019engage \u00e0 maintenir \u00e0 jour ces informations.
                      L\u2019Utilisateur s\u2019engage \u00e0 effectuer les mises \u00e0 jour de l\u2019Application qui sont n\u00e9cessaires \u00e0 son bon fonctionnement. L\u2019Utilisateur d\u00e9gage MANUFACTURE FRANCAISE DU CYCLE de toute responsabilit\u00e9 en cas de disfonctionnement de l\u2019Application imputable \u00e0 l\u2019absence d\u2019installation d\u2019une ou plusieurs mises \u00e0 jour.
                      L\u2019Utilisateur s\u2019engage \u00e0 toujours utiliser l\u2019Application conform\u00e9ment \u00e0 sa destination, \u00e0 savoir pour l\u2019usage de son propre v\u00e9lo SUNN, et dans le respect des lois et r\u00e8glementations en vigueur et des pr\u00e9sentes CGU.<\/p>


                      9. Engagements de la MANUFACTURE FRANCAISE DU CYCLE<\/strong>
                      L\u2019acc\u00e8s \u00e0 l\u2019Application est susceptible d\u2019\u00eatre \u00e0 tout moment suspendu ou limit\u00e9 pour les besoins d\u2019op\u00e9rations de maintenance. Par ailleurs, MANUFACTURE FRANCAISE DU CYCLE n\u2019a aucun contr\u00f4le sur les r\u00e9seaux de communication \u00e9lectronique, dont le r\u00e9seau internet, par lesquels l\u2019Application est accessible, de sorte qu\u2019elle ne peut en aucun cas \u00eatre tenue pour responsable de toute difficult\u00e9 ou impossibilit\u00e9 d\u2019acc\u00e8s \u00e0 l\u2019Application provenant de ces r\u00e9seaux.
                      En cas d\u2019incident sur l\u2019Application, signal\u00e9 par un Utilisateur ou constat\u00e9 par MANUFACTURE FRANCAISE DU CYCLE, MANUFACTURE FRANCAISE DU CYCLE s\u2019engage \u00e0 le prendre en compte et s\u2019efforcera de le r\u00e9soudre dans un d\u00e9lai raisonnable. Lorsque l\u2019incident est signal\u00e9 par un Utilisateur, MANUFACTURE FRANCAISE DU CYCLE ne s\u2019engage \u00e0 le prendre en compte et \u00e0 le r\u00e9soudre que si l\u2019Utilisateur donne \u00e0 MANUFACTURE FRANCAISE DU CYCLE des informations suffisantes pour l\u2019identifier et le reproduire. \u00c0 d\u00e9faut, MANUFACTURE FRANCAISE DU CYCLE n\u2019est tenue \u00e0 aucun engagement de r\u00e9solution et exclut toute responsabilit\u00e9 en cas de non-r\u00e9solution.<\/p>


                      10. Responsabilit\u00e9s <\/strong>MANUFACTURE FRANCAISE DU CYCLE<\/strong> ne pourra \u00eatre tenue responsable qu\u2019en cas de dommage caus\u00e9 directement \u00e0 l\u2019Utilisateur du fait d\u2019un manquement \u00e0 ses obligations contractuelles de fourniture des fonctions de l\u2019Application, lesquelles sont des obligations de moyens.
                      MANUFACTURE FRANCAISE DU CYCLE ne pourra pas \u00eatre tenue responsable en cas de dommage subi par l\u2019Utilisateur du fait de l\u2019utilisation de l\u2019Application lorsque ce dommage aura \u00e9t\u00e9 caus\u00e9 par le fait de l\u2019Utilisateur, le fait d\u2019un tiers, un cas de force majeure ou tout \u00e9v\u00e8nement hors de la pr\u00e9vision et du contr\u00f4le raisonnables de la MANUFACTURE FRANCAISE DU CYCLE, notamment une d\u00e9faillance de l\u2019infrastructure d\u2019h\u00e9bergement de l\u2019Application, des r\u00e9seaux de communication \u00e9lectronique ou de fourniture d\u2019\u00e9lectricit\u00e9.<\/p>


                      11. Garanties<\/strong>
                      L\u2019Utilisateur est inform\u00e9 des textes applicables aux garanties l\u00e9gales de conformit\u00e9 et des vices cach\u00e9s applicables \u00e0 la fourniture de services num\u00e9riques, dont les dispositions principales sont reproduites, ci-dessous.
                      11.1 Garantie l\u00e9gale de conformit\u00e9 des services num\u00e9riques (articles L. 222-25-12 et suivants du Code de la consommation)
                      Article L. 224-25-12 du Code de la consommation
                      \u00ab Le professionnel fournit un contenu num\u00e9rique ou un service num\u00e9rique conforme au contrat ainsi qu’aux crit\u00e8res \u00e9nonc\u00e9s \u00e0 l’article L. 224-25-14. Lorsque le contrat pr\u00e9voit une op\u00e9ration de fourniture ponctuelle du contenu num\u00e9rique ou du service num\u00e9rique, ou une s\u00e9rie d’op\u00e9rations de fourniture distinctes, le professionnel r\u00e9pond des d\u00e9fauts de conformit\u00e9 existant au moment de la fourniture et qui apparaissent dans un d\u00e9lai de deux ans \u00e0 compter de celle-ci.
                      Lorsque le contrat pr\u00e9voit que le contenu num\u00e9rique ou le service num\u00e9rique est fourni de mani\u00e8re continue, le professionnel r\u00e9pond des d\u00e9fauts de conformit\u00e9 qui apparaissent au cours de la p\u00e9riode durant laquelle celui-ci est fourni en vertu du contrat.
                      Le d\u00e9lai applicable ne prive pas le consommateur de son droit aux mises \u00e0 jour conform\u00e9ment aux dispositions de l’article L. 224-25-25.
                      Le professionnel r\u00e9pond \u00e9galement, dans les m\u00eames d\u00e9lais, des d\u00e9fauts de conformit\u00e9 r\u00e9sultant de l’int\u00e9gration incorrecte du contenu num\u00e9rique ou du service num\u00e9rique dans l’environnement num\u00e9rique du consommateur lorsque celle-ci a \u00e9t\u00e9 r\u00e9alis\u00e9e par le professionnel ou sous sa responsabilit\u00e9, ou encore lorsque l’int\u00e9gration incorrecte r\u00e9alis\u00e9e par le consommateur r\u00e9sulte de lacunes dans les instructions que le professionnel a fournies.
                      Ce d\u00e9lai de garantie s’applique sans pr\u00e9judice des articles 2224 et suivants du code civil. Le point de d\u00e9part de la prescription de l’action du consommateur est le jour de la connaissance par ce dernier du d\u00e9faut de conformit\u00e9. \u00bb
                      Article L224-25-14 du Code de la consommation
                      \u00ab I.- En plus des crit\u00e8res de conformit\u00e9 pr\u00e9vus au contrat, le contenu num\u00e9rique ou le service num\u00e9rique est conforme s’il r\u00e9pond aux crit\u00e8res suivants :
                      Il est propre \u00e0 l’usage habituellement attendu d’un contenu num\u00e9rique ou d’un service num\u00e9rique de m\u00eame type, compte tenu, s’il y a lieu, de toute disposition du droit de l’Union europ\u00e9enne et du droit national ainsi que de toutes les normes techniques, ou en l’absence de telles normes techniques, des codes de conduite sp\u00e9cifiques applicables au secteur concern\u00e9 ;
                      Le cas \u00e9ch\u00e9ant, il poss\u00e8de les qualit\u00e9s que le professionnel a pr\u00e9sent\u00e9es au consommateur sous forme de version d’essai ou d’aper\u00e7u, avant la conclusion du contrat ;
                      Il est fourni selon la version la plus r\u00e9cente qui est disponible au moment de la conclusion du contrat, sauf si les parties en conviennent autrement ;
                      En cas de fourniture continue d’un contenu num\u00e9rique ou d’un service num\u00e9rique pendant une p\u00e9riode donn\u00e9e, il est fourni sans interruption tout au long de cette p\u00e9riode ;
                      Le cas \u00e9ch\u00e9ant, il est fourni avec tous les accessoires et les instructions d’installation ainsi que l’assistance \u00e0 la client\u00e8le, auxquels le consommateur peut l\u00e9gitimement s’attendre ;
                      Le cas \u00e9ch\u00e9ant, il est fourni avec les mises \u00e0 jour que le consommateur peut l\u00e9gitimement attendre, conform\u00e9ment aux dispositions de l’article L. 224-25-25 ;
                      Il correspond \u00e0 la quantit\u00e9, \u00e0 la qualit\u00e9 et aux autres caract\u00e9ristiques, y compris en termes de fonctionnalit\u00e9, de compatibilit\u00e9, d’accessibilit\u00e9, de continuit\u00e9 et de s\u00e9curit\u00e9, que le consommateur peut l\u00e9gitimement attendre pour des contenus num\u00e9riques ou des services num\u00e9riques de m\u00eame type, eu \u00e9gard \u00e0 la nature de ces contenus ou services ainsi qu’aux d\u00e9clarations publiques faites par le professionnel, par toute personne en amont dans la cha\u00eene de transactions, ou par une personne agissant pour leur compte, y compris dans la publicit\u00e9 ou sur l’\u00e9tiquetage.
                      II.- Toutefois, le professionnel n’est pas tenu par toutes d\u00e9clarations publiques mentionn\u00e9es au dernier alin\u00e9a du I s’il d\u00e9montre :
                      Qu’il ne les connaissait pas et n’\u00e9tait l\u00e9gitimement pas en mesure de les conna\u00eetre ;
                      Qu’au moment de la conclusion du contrat, les d\u00e9clarations publiques avaient \u00e9t\u00e9 rectifi\u00e9es dans des conditions comparables aux d\u00e9clarations initiales ; ou
                      Que les d\u00e9clarations publiques n’ont pas pu avoir d’influence sur la d\u00e9cision de contracter.
                      III.- Le consommateur ne peut contester la conformit\u00e9 en invoquant un d\u00e9faut concernant une ou plusieurs caract\u00e9ristiques particuli\u00e8res du contenu num\u00e9rique ou du service num\u00e9rique, dont il a \u00e9t\u00e9 sp\u00e9cifiquement inform\u00e9 qu’elles s’\u00e9cartaient des crit\u00e8res de conformit\u00e9 \u00e9nonc\u00e9s au pr\u00e9sent article, \u00e9cart auquel il a express\u00e9ment et s\u00e9par\u00e9ment consenti lors de la conclusion du contrat. \u00bb
                      Article L224-25-17 du Code de la consommation
                      \u00ab En cas de d\u00e9faut de conformit\u00e9, le consommateur a droit \u00e0 la mise en conformit\u00e9 du contenu num\u00e9rique ou du service num\u00e9rique ou, \u00e0 d\u00e9faut, \u00e0 la r\u00e9duction du prix ou \u00e0 la r\u00e9solution du contrat, dans les conditions \u00e9nonc\u00e9es dans le pr\u00e9sent paragraphe.
                      Le consommateur a, par ailleurs, le droit de suspendre le paiement de tout ou partie du prix ou la remise de l’avantage pr\u00e9vu au contrat jusqu’\u00e0 ce que le professionnel ait satisfait aux obligations qui lui incombent au titre de la pr\u00e9sente sous-section, dans les conditions des articles 1219 et 1220 du code civil.
                      Les dispositions de la pr\u00e9sente sous-section sont sans pr\u00e9judice de l’allocation de dommages et int\u00e9r\u00eats. \u00bb
                      11.2 Garantie des vices cach\u00e9s (article 1641 et suivants du Code civil)

                      \u00ab Le vendeur est tenu de la garantie \u00e0 raison des d\u00e9fauts cach\u00e9s de la chose vendue qui la rendent impropre \u00e0 l\u2019usage auquel on la destine, ou qui diminuent tellement cet usage, que l\u2019acheteur ne l\u2019aurait pas acquise, ou n\u2019en aurait donn\u00e9 qu\u2019un moindre prix, s\u2019il les avait connus. \u00bb

                      12. Propri\u00e9t\u00e9 intellectuelle<\/strong>
                      Tous les \u00e9l\u00e9ments et contenus de l\u2019Application, en particulier mais sans s\u2019y limiter, les textes, logos, images, photos, dessins etc., sont et restent la propri\u00e9t\u00e9 intellectuelle exclusive de la MANUFACTURE FRANCAISE DU CYCLE et de ses partenaires. Tout autre acte que l\u2019utilisation de l\u2019Application \u00e0 des fins priv\u00e9es est interdit sous peine de contrefa\u00e7on, MANUFACTURE FRANCAISE DU CYCLE et ses partenaires se r\u00e9servent le droit d\u2019engager des poursuites.<\/p>


                      13. Donn\u00e9es personnelles<\/strong>
                      Les donn\u00e9es collect\u00e9es aupr\u00e8s de l\u2019Utilisateur font l\u2019objet d\u2019un traitement informatis\u00e9 par la soci\u00e9t\u00e9 MANUFACTURE FRANCAISE DU CYCLE en qualit\u00e9 de responsable de traitement.
                      Les informations nominatives collect\u00e9es sont n\u00e9cessaires au fonctionnement et \u00e0 la gestion de l\u2019Application.<\/p>


                      14. Modification des CGU<\/strong>
                      MANUFACTURE FRANCAISE DU CYCLE<\/strong> peut modifier les CGU \u00e0 tout moment. Dans ce cas, toute nouvelle version des CGU est syst\u00e9matiquement pr\u00e9sent\u00e9e \u00e0 l\u2019Utilisateur et soumise \u00e0 sa validation expresse. La validation de la nouvelle version des CGU mat\u00e9rialise l\u2019acceptation pleine et enti\u00e8re de celles-ci par l\u2019Utilisateur.<\/p>


                      15. Dispositions diverses<\/strong>
                      Les pr\u00e9sentes CGU sont constitu\u00e9es de l’int\u00e9gralit\u00e9 des clauses qui les composent. Le fait pour MANUFACTURE FRANCAISE DU CYCLE de ne pas se pr\u00e9valoir \u00e0 un moment donn\u00e9 de l’une quelconque des clauses des pr\u00e9sentes, ne peut valoir renonciation \u00e0 se pr\u00e9valoir ult\u00e9rieurement de ces m\u00eames clauses.
                      En cas d’invalidit\u00e9 de l’une d’entre elles, les autres clauses demeurent valables.<\/p>


                      16. Droit applicable et m\u00e9diation<\/strong>
                      Conform\u00e9ment \u00e0 l\u2019article L. 612-1 du Code de la consommation et sous r\u00e9serve de l\u2019article L. 612-2 du m\u00eame code, MANUFACTURE FRANCAISE DU CYCLE propose \u00e0 l\u2019Utilisateur, pour tout litige non r\u00e9solu en magasin ou par le service client, relatif \u00e0 la vente de produits ou \u00e0 la fourniture de service auquel ils seraient partie, la possibilit\u00e9 de recourir \u00e0 un m\u00e9diateur.
                      Pour exercer ce droit, adressez-vous au M\u00e9diateur de la M\u00e9diation de la Consommation du Commerce Coop\u00e9ratif et Associ\u00e9 (MCCA) par voie \u00e9lectronique : www.mcca-mediation.fr, ou par voie postale : M\u00e9diateur du Commerce Coop\u00e9ratif et Associ\u00e9 – FCA – 77, rue de Lourmel 75015 \u2013 Paris.
                      Le recours au m\u00e9diateur est gratuit.
                      Une fois le M\u00e9diateur saisi, ce dernier v\u00e9rifie que la demande rentre dans le champ de recevabilit\u00e9 de la m\u00e9diation de la consommation, puis d\u00e9cide de la recevabilit\u00e9 ou de l\u2019irrecevabilit\u00e9 du dossier.
                      En cas d\u2019irrecevabilit\u00e9, le M\u00e9diateur informe l\u2019Internaute du rejet de sa demande dans un d\u00e9lai de 3 semaines, \u00e0 compter de la r\u00e9ception du dossier complet. Sa d\u00e9cision est d\u00fbment motiv\u00e9e et insusceptible de recours. En cas de recevabilit\u00e9, le M\u00e9diateur rend un avis, au plus tard, dans un d\u00e9lai de 3 mois.
